Terms & Conditions
The following terms & conditions govern the rights and obligations of Vision Body Power Drivrn Health Club operating as (‘ENVISION Gym’) and members thereof.
1. ENVISION Future Fitness ‘The Club’ and/or ENVISION Gym
The Club is operated by Vision Body Power Drivrn Health Club (‘The Company’) whose principal objective is to provide health and fitness services for Club Members and Guests. The Home Club is where a member joins. The Company has appointed a management team (‘The Management’) who are responsible for the operation of the Club.
2. Membership
a) Memberships are available to individuals who are a minimum of 16 years of age. Any applicant below 16 and above 14 years of age must produce a letter of consent by the parent/guardian, however all visits must be accompanied by the parent/guardian and the junior member will be required to purchase PT and only train in the club with a Personal Trainer.
b) Memberships are personal to the member and are non-assignable, non-transferable and non-refundable. In exceptional circumstances a transfer will be considered at the discretion of the Club’s General Manager; however, an administration fee would be applicable. A member may not loan his/her membership card (if handed one) to be used by a third party.
c) Upon subscription, the member will be issued with a training account and a membership subscription, and the member shall be entitled to all the rights and privileges under the class of membership purchased.
d) Any member wishing to enter the Club without a valid membership will only be admitted at the absolute discretion of the Management on credit account.
e) Membership Fees:

I. All members shall settle the rates applicable for the chosen package prior to starting the service – packages fees are non-refundable, non-transferrable, including if the package hasn’t been used yet; any change of mind shall be entirely assumed by the client.
II. Membership fees are non-refundable upon renunciation or termination for any reason whatsoever; failure to use the service or non-usage of the sessions does not grant a refund.
III. The Management reserves the right to periodically review their prices, charges and fees and implement these accordingly.
IV. The Management will cancel any membership on which fees are unpaid yet attending on credit, thereafter the Management also has the right to continue to attempt to charge for these dues accordingly. Legal action will be taken to recover any outstanding dues from the member. You may not rejoin until the outstanding amount is paid.
V. All amounts payable under this Agreement are excluded of value added tax or similar indirect tax (“VAT”). If a VAT shall be imposed by law on the services payable under this Agreement, the fees shall be increased by an amount equal to the amount of VAT, applicable at the prevailing rate at the time such implementation will be made. Payment of VAT, as applicable under law, is a prerequisite under this Agreement.
f) Freezing Membership
Members can apply to ‘freeze’ their membership according to the Club policies. In all cases the Club has the right to ask for supporting documentation. To freeze a membership a member must inform the front desk prior or request for a specific date the ‘freeze’ to take effect.
3. Physical Condition of Members
a) The member warrants and represents that he/she is in good physical condition and that he/she knows of no medical or other reason why he/she is not capable of engaging in an active or passive exercise program and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition.
b) It is the member responsibility to update the Club in writing with any information that might affect their ability to engage safely in physical activity in clubs.
c) The member shall not use any Club facilities whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.
d) Members and their guests exercise and use the facilities at their own risk and are advised to consult their physician prior to commencing any type of physical exercise.
4. Expulsion of Members
The management may terminate the membership of any member:
a) Without notice and with immediate effect if a member’s conduct, whether (or not) such conduct is the subject of complaint by another member or members, is such that in the reasonable opinion of the Management, it is harmful to the character and/or interests of the Club.
b) Without notice and with immediate effect if the Management is of an opinion that the member shall have committed any breach of the Club Rules & Regulations’ that the Club has in place.
c) If a member is rude, aggressive or in any way disrespectful to another member or to any of the Club employees, this includes foul/bad language.
d) If any monthly membership fees or any other fees such as Personal Training etc. remain unpaid after the due date for payment.
e) Upon notice in writing, if the Management is of the opinion that the member is not a suitable individual for continued membership of the Club.
f) If a member is found to have violated the privacy of any other member within the lockers and the changing rooms or are caught in lewd or compromising actions, this includes ignoring or disrespecting the Club’s ‘No Nudity’ policy in the changing room area.
A member whose membership is terminated by the Management shall forfeit all the privileges of membership with immediate effect without claim of any refund.
5. Guests and Visitors
a) For security reasons, all guests and visitors are required to provide a photo ID and fill up a guest/ trial form. A copy and/or ID number will be retained on record.
b) Members are not permitted to use a guest free trial to gain access without charge for the Club services.
c) Guests will have the same membership privileges as the member who introduced them and will be subject to the same Club rules and limitations of liability as the member. It is the responsibility of the member introducing a guest to ensure that their guest complies with the Club rules.
d) The Management reserves the right to exclude any guest from the Club without giving any reason for doing so and change the charges levied for guest passes from time to time.
e) Any guest of a member or a temporary visitor to the Club shall agree to abide by the Club rules and the same limitation of liabilities for a member shall apply.
7. Health and Safety
a) All members are required to complete the mandatory App Account prior to session 1 (or trial session), before commencing the training program with one of the Club’s Fitness Instructors, thereafter any further training sessions can be conducted.
b) Members should be considerate of other members by using own workout towel when using any of the exercise stations.
c) Members are requested to return all portable equipment after use including free weights and dumbbells to the racks provided.
ad) Fitness Instructors are authorized to stop anyone from exercising if in their opinion the member/guest is exercising in a manner that may result in personal injury and or injury to others. Users must abide by the guidance of the Fitness Instructors and comply with all points clearly stated regarding the power suits wearing and removing.
e) Smoking is not permitted in any part of the Club.
f) Members or guests may not use the facilities of the Club whilst under the influence of alcohol, narcotics or other mood-altering substances.
7. Operating Hours
The Management reserves the right to adjust the hours for the purpose of cleaning, decorating, repairs, and special private functions and holidays. The Management shall endeavor to give reasonable notice of any change in the hours of operation.
Last admission will be allowed one hour before closing and you are requested to leave the Club premises punctually at the time of closing.
8. Dress Code
All members and guests are required to wear the power suits offered at the gym (or their own personal power suits) prior to exercising and to wear sport shoes adequate for exercising, or bare feet (rather than wrong fitting sport shoes).
9. Club Facilities
a) The Management accepts no responsibility for loss or damage to a member’s personal belongings left in the lockers for any reason whatsoever.
b) The use of mobile phones with camera features and/or any other types of visual recorders in changing rooms are strictly prohibited. Members breaching this rule will be handed over to the authorities to be dealt with accordingly.
c) The Management may from time to time show potential members or others around the Club and allow them to use the Club’s facilities on a trial basis and reserves the right to do so.
10. Training and Exercising
a) Personal Training can only be conducted by ENVISION employed trainers that are qualified and certified.
b) Members can attend maximum 1 class each 48h or 2 (two) classes/ week.
c) All sessions must be completed on or before the subscription expiry date, any subscription freezing (or extension) must be authorized by the General Manager (after ensuring all relevant paperwork to support the contract extension has been received if needed).
d) The Club reserves the right to provide a replacement qualified Personal Trainer if the current trainer is not available (this will be at the Management’s discretion).
e) Notice of cancellation of PT sessions must be given at least 4 hours in advance of the scheduled appointment time. Failure to attend a scheduled PT session without notice will result in the session being deducted or fully charged.
f) All subscription types or sessions purchased are non-refundable and non-transferable.
g) For Group Training members MUST come 10 minutes prior to every class starting.
h) Members are not allowed to enter the studio once the class has started (unless authorized by the trainer conducting the class).
i) Members are asked to refrain from using mobile phones in all classes.
12. Lockers
a) Unclaimed belongings will be kept by the Club for a period of 1 week after which the Management reserves the right to dispose of the items in any way it sees fit. The Management does not take any responsibility for the items kept in the lockers.
b) Please do not keep any money or valuables in your locker, the Club cannot be held responsible for any loss or damages.
c) If a member loses or damages a key/lock he/she will be responsible to pay a fee to replace the key and/or lockset if necessary.
d) Lockers must be kept tidy and in order and power suits and towels must be deposited in the locker basket.
13. Others
a) The Management reserves the right to use any individual or group photographs of members and/or guests for press or promotional purposes.
b) All members must abide by the rules of the Club which may be amended and/or added to from time to time at the Management’s Discretion.
c) Failure by the Management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
d) All brandings, designs, logos and Club interiors form the brand identity. Members and/or guests are not allowed to photograph or copy any Club interior designs, promotional materials, tag lines, themes or concepts. ENVISION Gym reserves the right to proceed with legal action to any member caught distributing, sharing or supplying such contents to any third-party vendor or competitor.
e) Terms and Conditions apply to all member and non-member promotions and must be followed if one has agreed to take part in the promotion. It is your responsibility to familiarize yourself with the Ts&Cs before participating in promotions.
f) If you are eligible for a 1-month free promotion or complimentary package the Club regular Ts&Cs apply, plus:

1. You must bring the voucher to be eligible for promotion redemption.
2. You must follow the redemption rules as stated on the voucher.
3. Not redeemable for cash & not exchangeable.
4. Not transferrable.
5. Lost vouchers will not be replaced, and only original voucher must be handed in to reception.
6. The earliest the voucher can be redeemed is in the last month of your minimum term that excludes any freeze period.
7. Restrictions may apply.
8. Membership must be valid/active and clear of arrears at the time of using their voucher.
9. Voucher allows entry to the existing membership tier only.
10. Voucher redemption remains subject to Management discretion.
g) All member and non-member promotions must be followed by the Ts&Cs specified accordingly.
14. Limitation of Liability
I. In consideration of the Management accepting his/her application for membership of the Club and for him/her becoming and remaining a member of the Club, the member agrees that:

a) Vision Body Power Drivrn Health Club (ENVISION Gym) or its subsidiaries accepts no responsibility for loss, for damage to members’ or their guests’ properties, for injuries sustained while on the premises or death. Members and their guests agree that no claims will be made against the Company, the Management or staff for any reason whatsoever.
b) Vision Body Power Drivrn Health Club (ENVISION Gym), its associated companies, employees or agents shall not be responsible for any claims, demands, injuries, damages or actions for negligence arising on account of death or due to injury, loss, damage or theft to member’s personal property arising out of or in connection with the use by a member of any of the services, facilities on the premises of Vision Body Power Drivrn Health Club (ENVISION Gym). The member hereby holds the Company, its associated companies, employees and agents harmless from all claims which may be brought against them by or on a member’s behalf for any such injuries or claims aforesaid.
c) Any advance payments towards fitness classes, sports hall usage or any other payable activates, will not be refundable or transferable.
II. Promotions:

a) You must bring the original voucher to be eligible for promotion redemption with a unique Voucher Code number given to you.
b) You must follow the redemption rules as stated on the voucher.
c) Not redeemable for cash & not exchangeable.
d) One voucher per person.
e) Lost vouchers will not be replaced, and only original voucher must be handed in to reception.
f) The earliest the voucher can be redeemed is in the last month of your minimum contract term that excludes any freeze period.
g) Membership must be valid/active and clear of arrears at the time of using their voucher.
h) Voucher allows entry to the existing membership tier only.
j) It is the member responsibility to ensure that they meet the stated above T&C’s to enjoy the promotion.
